Unit 1 - Fair Dealing - TESL 0150

Fair Dealing
Part 1: 
Firstly, the use of the Chainsmokers song in the unit title. We must consider the fair dealing factors: 
  • purpose of the dealing; the purpose is for education. It is used as a creative hook statement for the readers
  • character/nature of the dealing;  the lines are only available on a restricted access learning management system
  • amount of the dealing; two lines from the song: "Where'd you wanna go? How much you wanna risk?" (The Chainsmokers & Coldplay, 2017) less than 10% of the origin material, 
  • effect of the dealing on the work/impact on the market: this use would have virtually zero negative impact on the market, the line is restricted access and uses less than 10% of the original work. It may actually have a positive impact on the market as students may look up the song to stream, download, etc. 
In conclusion, I believe the lyric used at the beginning of the unit title constitutes fair dealing. 
Part 2: 
  • The resource I chose for my classroom is example essays from the University of Sussex which can be found at the following link:
  • http://www.sussex.ac.uk/skillshub/?id=282
  • purpose of the dealing; the purpose is for education. For students to see an example of real academic essays that other University students have completed. 
  • character/nature of the dealing; these essays are available to the public, they are owned by the University of Sussex and are distributed to assist their students with academic writing. It is noted that "these essays are not to be used as model answers or followed for referencing guidance."
  • amount of the dealing; I would use portions of each essays to find good examples of formatting and structure. 
  • alternatives to the dealing; There are several alternatives to this dealing, there are many free examples of student essays on the internet. 
  • Impact on the market; This may have a negative impact on the market as I could purchase essays from an official academic website. However, for my particular context, I want the students to see real student examples not only professional academic writing. 
In conclusion, I believe these example essays constitute fair dealing in Canadian because of the purpose and the nature of the dealing.
